Annual Patient Safety Attestation: action required for compliance

As a qualified health plan (QHP) issuer, we must ensure compliance with federal regulation 42 CFR 156.1110 when contracting with hospitals with more than 50 beds. We require participating hospitals to attest to meeting the regulation’s patient safety standards annually by completing the Patient Safety Attestation Form no later than June 30, 2025, and returning it to their provider network manager/contractor.

The regulation mandates QHPs verify that hospitals meet these specific patient safety standards:

  • The hospital must use a patient safety evaluation system as defined in 42 CFR 3.20 by:
    • Collecting and reporting data to patient safety organizations (PSOs).
    • Implementing a mechanism for comprehensive person‑centered hospital discharge.
    • Improving care coordination and healthcare quality for each patient.
  • If the hospital is not working with a PSO, it must implement an evidence‑based initiative to improve healthcare quality, reduce preventable harm, prevent readmission, and improve care coordination.
